Is it okay that some YouTubers make money off their Call of Duty content?

Is it okay that some YouTubers (Or whoever) make money off their Call of Duty (and other Activision) content?

From what I've seen and read, it doesn't seem Activision is cool with gameplay being monetised and that the only people who are making money off this content are people who used the vague-ness of Activisions rules and guidelines for their own benefit.
Is it okay that these people have broke the rules?
Is Activision being horrible, unfair and or stuck up?
What are your thoughts?

You need a network. If you turn on adsense on your CoD videos without a network you will get a strike or have adsense ban you.

I've only ever not been able to monitize my videos if there is music in it

And one of my videos the jugg jingle was incorrectly picked up as a song by some band that hasn't been around since the 60s

Now Nintendo on the other hand, they do have this rule - unless you sign as a "Nintendo partner" - meaning you only get 30%

We should just change it to 'Gameplay Monetise'.
I wish more companies came out on whether they are cool with monetisation or not.
