There are people that dont want us to be present at ZM anymore, Stig i remember you being against us as well.

As you may or may not know, we have some rules on this site about how to conduct yourself.

it may come to your attention that two separate rules (3 and 4) were breached when you made this topic.

Usually, we implement a three-strike warning system, but considering you've violated more than one rule, I find it within my power to ban your ass. Go back to ZM and spread your hate there, chum, we like to maintain a positive atmosphere here. :)

Do you REALLY want me to start listing the problems with ZM?

1. the admins act like 3 year olds.

2. the admins allow boot kissers to control them.

3. the people in charge of ZM have broken activisions agreement with mod tools more than once, in other words they are illegally using mod tools.

4. Majority of the members on ZM are haters, trolls, or (again) act like 3 year olds.

?   New Game Materials must not contain any illegal, obscene or defamatory materials, materials that infringe rights of privacy and publicity of third parties or (without appropriate irrevocable licenses granted specifically for that purpose) any trademarks, copyright-protected works or other properties of third parties.

i think this is the rule where you can't have any pornographic pictures in maps.

Technically the map creator(s) is responsible for upholding that agreement, not ZombieModding.

yes, but what happens when the owner of the site(DarkFlame) violates the agreement alongside everyone else who also has violated it?

really the question that i'm wondering/asking is if activision has the right to take down a site that (majority) consists of members who has violated their terms. Chances are if they really cared enough (which case it doesn't look like they do) they could take it down regardless if it's individual members or the whole site that's doing it.

the government however has more power than activision does, but I'm sure they have a few government workers hired in case they get sewed

You have a point, but honestly we need to take a step back and look at the broad reality of the situation, which is that Activision has stepped away from the idea of Mod Tools because it takes away profit from their map pack sales.

Activision wants to distance themselves as much as possible from community content and basically pretend that we don't exist anymore. For them to carry out legal action on a community based on a game so old would not be a wise use of their money, and would seriously hurt their public image for thousands of people. It would mean the end of this entire community, and the end of the "idea bank" that Treyarch so frequently refers to for free ideas.

One side of the coin is definitely that ZM is a large source of attention towards custom content, and if Activision wanted them gone then they could easily take legal action upon the multiple licensing agreement infractions you have mentioned (pornography, lack of mod identification, 3rd party content violations (copyrighted music), etc), which is an effective and legally justifiable way to completely take down the site as well as the modding community.

The other side of the coin is what I mentioned above, which is that it would seriously hurt Activision's public image. Thousands upon thousands people know that there is a custom community for all of the CoD games, so a major slap from Activision would hurt everyone.

Lastly you both mentioned government action - this is completely unrealistic. The US Government only prosecutes  federal crimes. Federal crimes are a violation of federal law. The Activision license agreement is simply a Terms of Use, which can only be used by Activision to control how their tools are used. The government would have absolutely no involvement in that - only private sector lawyers would touch it.

That's all I can really think of. Also some people think they stole moon, but they planed for that since before black ops.

well i'm not 100% sure but i think anything that comes in contact (or can be used by) mod tools is activisions property. i havn't really understood that part of the agreement very well.

Anything created using the Mod Tools is the intellectual property of Activision which may not be sold or otherwise commercialized.
